1. Introduction and Legal Terms
1.1 Welcome to PrimeLoans, where we provide fast, simple, and secure short-term loans that you can apply for online in less than 15 minutes (the “Services”). By accessing or using our platform at https://primeloans.co.za , or any related platform (collectively, “the Platform”), you confirm that you have read, understood, and agreed to be bound by the terms and conditions set forth herein (“Terms”). All rights to the content on the Platform remain expressly reserved by PrimeLoans.
1.2 PrimeLoans is a registered credit provider with NCR registration number NCRCP20937.
1.3 These Terms outline the conditions governing your use of the Platform. Please ensure you read these Terms carefully before engaging with the Platform or our Services. By continuing to use the Platform, you signify your understanding and acceptance of these Terms.
1.4 Please pay particular attention to the bold sections of these Terms. These sections highlight important limitations of liability, assumptions of risk, and obligations on your part, as well as acknowledgments of specific facts.
1.5 The terms “user,” “you,” and “your” refer to any individual accessing the Platform. The terms “us,” “our,” and “we” refer to PrimeLoans and its affiliates.
2. Our Services and Creating a Profile
2.1 Loan Application: Our Platform allows you to apply for a short-term loan and receive results within 15 minutes. Upon receiving a loan, you will be presented with a pre-agreement statement and quotation for your review and approval. Once approved, you will receive a credit agreement, which should be read alongside these Terms. As long as your loan account remains active, you are bound by these Terms, the pre-agreement statement, the quotation, and the credit agreement.
2.2 Creating a Profile: To access the Platform and apply for a loan, you must create a user profile. During the loan application process, you will be required to complete an online application form and provide all necessary information.
2.3 Profile Features: Upon approval of your loan application, you gain access to your customer profile. From this profile, you can make payments, access statements, review your credit history, and request settlement letters.
2.4 Accurate Information: By signing up for our Services, you agree to provide accurate, current, and complete information, updating it whenever necessary. To protect your privacy and security, we take reasonable steps to verify your identity by requiring your email address and password to access your account. Update your details directly via your profile or contact us for assistance.
2.5 Warranty: You confirm that all personal information provided is accurate and that the individual using the Platform and Services is you. You bear full responsibility for the information shared and all actions taken on your account. Refer to our Privacy Policy for details on how your personal data is managed.
2.6 Unlawful Access: Notify us immediately if you suspect unauthorized access to your profile, such as through the loss, theft, or misuse of your login credentials or payment information, to mitigate potential liability for unauthorized charges.
3. Ways to Pay
3.1 Instalment: When you receive a loan, we determine the minimum monthly payment required to repay the loan (“Instalment”).
3.2 Payment Methods: You can pay your Instalment via electronic funds transfer, debit order, or online payment. Payments are made at your own risk and will only be recognized as valid once received and credited to your account.
3.3 Payment Allocation: Payments are applied in the following order:
3.3.1 Toward any due or unpaid interest;
3.3.2 Toward any due or unpaid fees or charges; and
3.3.3 To reduce the Principal Debt (as defined in the credit agreement).
3.4 Early Payment: You are encouraged to make early payments, which will be credited to your account. If any balance remains outstanding after an early payment, it will be due on the agreed Instalment date.
3.5 Secure Payments: We prioritize secure online payment systems. All transactions are encrypted using advanced encryption technologies provided by our payment service providers. When using these services, their respective terms and policies will apply to your transactions.
4. Responsibilities and Warranties
4.1 By accessing or using the Platform and/or Services, you warrant and agree that:
4.1.1 You have thoroughly reviewed and accepted these Terms and will adhere to them while using the Platform and Services.
4.1.2 The information you provide during the application process is truthful, accurate, and complete in all respects, without any misrepresentation.
4.1.3 You are at least 18 (eighteen) years of age and possess the legal capacity to enter into and be bound by these Terms.
4.1.4 You lawfully possess and provide all information submitted to PrimeLoans for the purpose of accessing the Platform or Services.
4.1.5 You will not post, upload, or transmit any content on the Platform that could be deemed abusive, obscene, defamatory, harassing, racist, sexist, discriminatory, or in violation of privacy or confidentiality.
4.1.6 You will not use software, routines, or devices to interfere with the functionality or operation of the Platform, including but not limited to uploading corrupted data, introducing viruses, or tampering with the interface or underlying software code.
4.1.7 You will respect the intellectual property rights of others and will not upload or share any content that you do not own or lack the rights to distribute.
4.1.8 You will not use the Platform or Services for unauthorized commercial purposes or in contravention of any laws or regulations, including those related to financial crimes or money laundering.
4.1.9 You will not assist or enable third parties to engage in any of the prohibited activities mentioned above.
4.2 A breach of any of these warranties constitutes a material violation of these Terms, granting us the right to deny access to the Platform or Services, report the activity to relevant authorities, or initiate legal proceedings.
4.3 It is your responsibility to ensure that your device is compatible and connected to the internet to use the Platform. We are not responsible for any issues arising from incompatibility or connectivity.
4.4 We reserve the right, at our discretion, to deny access to the Platform or Services if we believe you have violated these Terms or any other applicable agreement with PrimeLoans.
5. Messages and Advertising
5.1 Data Messages Between You and PrimeLoans
5.1.1 Any data messages you send to us, including emails, will only be deemed received once we acknowledge or respond to them.
5.1.2 Data messages from us to you will be considered received once they enter your email server inbox and can be retrieved by you.
5.1.3 We reserve the right not to respond to messages containing content that is obscene, threatening, defamatory, or otherwise unlawful. We may also take appropriate action against senders of such messages if necessary.
5.1.4 Messages transmitted over the internet are not guaranteed to be completely secure and may be intercepted or corrupted. We are not liable for inaccuracies or breaches of security resulting from internet communication.
5.2 Hyperlinks, Deep Links, and Framing
5.2.1 The Platform may include links to external websites (“other sites”). PrimeLoans neither owns nor endorses these sites and is not responsible for their content, products, or services.
5.2.2 Hyperlinks to external sites do not imply any endorsement or agreement with the content or services provided by those sites.
5.2.3 Accessing or using external sites is done at your own risk and is subject to the terms set by their operators.
6. Intellectual Property and Confidentiality
6.1 Platform Intellectual Property
6.1.1 The layout, content, software, icons, text, graphics, trademarks, and all other intellectual property on the Platform (“Intellectual Property”) are owned by or licensed to PrimeLoans and are protected under domestic and international laws.
6.1.2 All Intellectual Property rights remain reserved by PrimeLoans and its licensors.
6.2 License to Use
6.2.1 You retain ownership of any intellectual property you provide to us but grant us a non-exclusive, non-transferable license to use such property to provide our Services.
6.2.2 Except as explicitly permitted, you may not copy, modify, distribute, or exploit any Intellectual Property on the Platform without prior written consent from PrimeLoans.
6.3 Platform Changes
6.3.1 We reserve the right to modify or discontinue any aspect of the Platform or Services, including Intellectual Property, without prior notice. Transactions already completed will not be affected.
6.4 Third-Party Licenses
6.4.1 Intellectual Property belonging to third parties is subject to the terms imposed by those licensors. You agree to comply with any such terms.
6.5 License to Display
6.5.1 We grant you a limited, non-transferable license to display content from the Platform on your device for personal use. This does not confer ownership or the right to exploit any Intellectual Property.
6.6 Confidentiality
6.6.1 Information you provide during the application process is treated as confidential and will not be disclosed unless legally required or already public. This confidentiality obligation survives termination of these Terms.
7. Indemnities, Disclaimers, and Warranties
7.1 Disclaimers
7.1.1 The Platform and Services are provided “as is” and “as available” without warranties of any kind, express or implied.
7.1.2 PrimeLoans, its employees, directors, and affiliates accept no liability for direct, indirect, or consequential losses arising from the use of the Platform or Services.
7.1.3 While we take reasonable measures to ensure the security of the Platform, we do not guarantee uninterrupted or error-free access, nor can we guarantee that the Platform is free from harmful components such as viruses or malware. Use is at your own risk.
7.2 Indemnities
7.2.1 You agree to indemnify and hold harmless PrimeLoans, its employees, and affiliates against any claims, damages, or losses arising from your use of the Platform or Services in violation of these Terms.
7.2.2 This indemnity survives termination of these Terms.
8. Dispute Resolution
8.1 Negotiation: In the event of any dispute, disagreement, or claim arising between you and PrimeLoans regarding the use of the Platform or Services, both parties agree to engage in amicable negotiations to resolve the matter, prioritizing mutual benefit and understanding.
8.2 Mediation: Should negotiations fail to resolve the dispute within a reasonable timeframe or any mutually agreed extension, the matter will be referred to an independent industry expert to mediate discussions and facilitate a fair resolution.
8.3 National Credit Act Compliance: In accordance with the National Credit Act, if you hold a loan with PrimeLoans, you have the right to:
8.3.1 Seek resolution through alternative dispute resolution mechanisms;
8.3.2 File a formal complaint with the National Credit Regulator; or
8.3.3 Submit an application to the National Credit Tribunal.
8.3.4 You may also contact the National Financial Ombud Scheme on 0860 800 900.
8.4 Confidentiality: Both parties explicitly agree to refrain from publicizing any disputes on social media or other public platforms, understanding that such actions could cause reputational and financial harm, potentially leading to legal claims against the infringing party.
9. Termination of Use
9.1 In addition to other rights outlined in these Terms, PrimeLoans reserves the right to limit or terminate your access to the Platform and/or Services in the event of a breach of these Terms, provided reasonable notice is given.
9.2 If you wish to terminate your agreement with us and these Terms, you may do so following the process outlined in the applicable credit agreement. Termination will not affect any lawful rights or obligations accrued prior to termination.
10. Notices and Service Address

10.2 Either party may update their designated service address by providing written notice to the other party. Changes will take effect 14 (fourteen) days after the notice is served. Notices written in English and successfully delivered will be deemed valid, even if not sent in strict accordance with this clause.

12. General Provisions
12.1 Relationship Between the Parties: These Terms govern the relationship between the parties and do not create a partnership, joint venture, or employment relationship. Neither party may bind the other to any obligations without express consent.
12.2 Force Majeure: Neither party shall be held liable for failure or delay in fulfilling their obligations due to circumstances beyond their control, including but not limited to natural disasters, governmental restrictions, or other unforeseen events. Performance obligations will be suspended during such events, with both parties striving to minimize delays.
12.3 Amendments: These Terms and the Platform’s content may be updated or amended at PrimeLoans’ discretion. Changes will take effect upon being posted to the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.
12.4 Entire Agreement: These Terms represent the full agreement between the parties regarding their subject matter, except where supplemented by a credit agreement. No modifications shall be valid unless documented in writing and signed by both parties.
12.5 No Waiver: Any leniency or extensions granted by PrimeLoans shall not constitute a waiver of rights. PrimeLoans retains its rights to enforce any provisions at its discretion.
12.6 Interpretation: Words in the singular include the plural and vice versa. Gender-specific terms include all genders. References to persons include entities and vice versa.
12.7 Headings: Section headings are for convenience only and do not influence the interpretation of these Terms.
12.8 Governing Law: These Terms and any related interactions are governed by the laws of the Republic of South Africa.
12.9 Severability: If any clause or provision is deemed invalid or unenforceable, the remainder of the Terms will remain in full force and effect.
12.10 Compliance with Legislation: No provision of these Terms shall violate any mandatory consumer protection laws or regulations. Any non-compliant provision will be interpreted in line with clause 12.9 to preserve its intent within legal limits.
